1. Agreement to These Terms
Welcome to USMilitary.org (the “Website”). These Terms of Use (“Terms”) are a binding agreement between you and Elevation Marketing Inc., a North Carolina corporation doing business as USMilitary.org (“USMilitary.org,” “we,” “us,” or “our”).
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
These Terms apply to the Website however you access it — personal computer, mobile device, tablet, or otherwise — and to any interactive features, applications, tools, calculators, downloads, email communications, and forms that we operate and that link to these Terms.
These Terms incorporate by reference our Website Disclaimer and Privacy Policy and our California Privacy Policy. Together they govern your use of the Website.
Please read Section 15 (Disclaimer of Warranties), Section 16 (Limitation of Liability), and Section 17 (Binding Arbitration and Class Action Waiver) carefully. They limit our liability to you and affect how disputes between us are resolved.
2. We Are Not a Government Agency
USMILITARY.ORG IS A PRIVATELY OWNED AND OPERATED WEBSITE. WE ARE NOT AFFILIATED WITH, ENDORSED BY, OR ACTING ON BEHALF OF THE U.S. DEPARTMENT OF VETERANS AFFAIRS, THE U.S. DEPARTMENT OF DEFENSE, ANY BRANCH OF THE UNITED STATES ARMED FORCES, OR ANY OTHER FEDERAL, STATE, OR LOCAL GOVERNMENT AGENCY.
Official information about veterans’ benefits is available free of charge from the U.S. Department of Veterans Affairs at va.gov and by telephone at 1-800-827-1000. Official military pay and personnel information is available from the Defense Finance and Accounting Service at dfas.mil.
References on the Website to government agencies, programs, benefits, ranks, insignia, or publications are for informational and identification purposes only and do not imply any affiliation, sponsorship, or endorsement.
3. Eligibility
The Website is intended for use by individuals who are at least eighteen (18) years old. By using the Website, you represent that you are at least eighteen (18) years old and legally able to enter into this agreement.
The Website is not directed to children. We do not knowingly collect personal information from children under thirteen (13). See our Privacy Policy for how we handle such information if we learn we have received it.
4. Changes to These Terms
We may modify these Terms at any time. When we do, we will update the “Last Updated” date above and post the revised Terms on the Website. Material changes will be accompanied by a notice on the Website.
Your continued use of the Website after revised Terms are posted constitutes your acceptance of them. If you do not agree to the revised Terms, stop using the Website. We encourage you to review these Terms periodically.
5. No Professional Advice
The Website provides general information only. Nothing on the Website is professional advice of any kind, and no professional relationship is created by your use of it.
Specifically, and without limitation:
Not benefits, claims, or legal advice. We are not accredited by the U.S. Department of Veterans Affairs to prepare, present, or prosecute claims for veterans’ benefits, and we do not do so. We do not represent claimants before the VA. Assistance with a VA claim is available free of charge from accredited Veterans Service Organizations, state and county veterans service officers, and VA-accredited attorneys and claims agents. Nothing on the Website is legal advice and no attorney-client relationship is created.
Not financial, tax, investment, or insurance advice. Content about pay, retirement, the Thrift Savings Plan, mortgages, home equity, insurance, savings, or taxes is general educational information. It is not a recommendation to buy, sell, hold, or apply for any product, and it does not account for your individual circumstances. We are not a licensed financial adviser, investment adviser, tax adviser, insurance producer, mortgage lender, or mortgage broker.
Not medical advice. Content about TRICARE, CHAMPVA, VA health care, disability conditions, or ratings is general information and is not medical advice, diagnosis, or treatment. It is not a substitute for consultation with a qualified health care provider.
Eligibility determinations are made by the responsible agency or provider, not by us. Whether you qualify for any benefit, program, rating, loan, or product — and on what terms — is determined solely by the agency, lender, insurer, or provider involved.
Consult a qualified professional before acting. You should consult an accredited representative, attorney, financial professional, tax professional, insurance professional, or health care provider, as appropriate, before making any decision based on information from the Website.
6. Accuracy and Currency of Information
Benefit rates, eligibility rules, pay tables, program requirements, tax thresholds, and interest rates change — often annually, and sometimes without notice. Content that was accurate when published may be out of date when you read it.
We make reasonable efforts to keep the Website accurate and current, but we do not warrant that any information on the Website is accurate, complete, current, or applicable to your situation. Verify anything you intend to rely on with the responsible agency or a qualified professional before acting on it.
Calculators, estimators, and similar tools on the Website produce illustrative estimates only. They are not offers, quotes, approvals, benefit determinations, or guarantees of any amount or outcome. Actual figures are determined by the responsible agency, lender, or provider.
7. Advertising, Affiliate Relationships, and Lead Generation
The Website is supported by advertising and by compensation from third parties. Assume that we may be paid in connection with anything on the Website that links to, refers you to, or collects your information for a third party.
Advertising. The Website displays advertising, including interest-based advertising served through third-party networks. We do not control which specific advertisements appear. The presence of an advertisement is not an endorsement.
Affiliate compensation. We participate in affiliate and referral programs and may receive compensation when you click certain links, submit an inquiry, or purchase or apply for a product or service. This compensation may influence which products or services appear on the Website, and in what order. It does not change the price you pay.
Lead generation and forms. Certain pages contain forms, comparison tools, and rate widgets that collect information and transmit it to third-party lenders, insurers, marketing partners, or their service providers. When you submit such a form:
- You are providing your information to those third parties, who will use it under their own privacy policies and terms, not ours;
- We may be compensated for the referral, whether or not you obtain any product or service;
- If you provide a telephone number and consent to be contacted, you may receive calls or text messages, including autodialed or prerecorded calls, from those third parties. Any such consent is given at the form itself and is not a condition of purchase. The specific consent language presented at the form governs;
- We are not a lender, mortgage broker, insurance producer, or provider of any product offered through those third parties. We do not make credit decisions, approve applications, set rates or terms, or guarantee that you will be approved or receive any particular offer.
Third-party responsibility. We are not responsible for the acts, omissions, products, services, privacy practices, marketing practices, or communications of any third-party advertiser, lender, insurer, or partner.
8. Third-Party Websites and Content
The Website contains links to third-party websites and may display third-party content. We do not control and are not responsible for those sites or that content, including their accuracy, legality, privacy practices, or availability. A link is not an endorsement.
Your use of any third-party website is at your own risk and is governed by that site’s own terms and privacy policy. Review them before providing any information.
9. Intellectual Property
Except for content owned by third parties, the Website and all of its content — text, articles, graphics, photographs, illustrations, charts, calculators, tools, software, code, page design, layout, and the selection and arrangement of all of it — is owned by us or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
“USMilitary.org” and our logos are our trademarks. You may not use them without our prior written permission. Third-party trademarks, service marks, and trade names appearing on the Website are the property of their respective owners and are used for identification purposes only.
Limited license. We grant you a limited, revocable, non-exclusive, non-transferable license to access the Website and to view, download, and print content for your own personal, non-commercial use only. You must retain all copyright and other proprietary notices on any content you copy.
You may not, without our prior written permission: reproduce, republish, distribute, display, sell, license, or create derivative works from Website content; use any content for commercial purposes; or remove or alter any proprietary notice.
This license terminates automatically if you breach these Terms.
10. Prohibited Conduct
You agree that you will not:
- Use the Website for any unlawful purpose or in violation of these Terms;
- Use any robot, spider, scraper, crawler, or other automated means to access, monitor, copy, or extract content from the Website, or to collect information about other users, except for search-engine crawlers operating in accordance with our robots.txt file;
- Use Website content to train, fine-tune, or develop any machine learning or artificial intelligence model, or to build any dataset for that purpose, without our prior written permission;
- Bypass, disable, or interfere with any security, access-control, rate-limiting, or advertising feature of the Website;
- Frame, mirror, or otherwise reproduce any part of the Website on another site;
- Introduce viruses, malware, or other harmful code;
- Attempt to gain unauthorized access to the Website, its servers, or any related systems;
- Impose an unreasonable or disproportionately large load on our infrastructure;
- Reverse engineer, decompile, or disassemble any portion of the Website;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Harvest email addresses or other contact information for the purpose of sending unsolicited communications;
- Use the Website in any manner that could damage, disable, overburden, or impair it, or interfere with any other party’s use of it.
We may investigate and take any action we consider appropriate in response to a violation, including removing content, restricting access, and cooperating with law enforcement.
11. Comments and Other User Submissions
The Website may from time to time permit comments, reviews, questions, or other submissions (“User Content”). Comment functionality may be open, limited, or closed at our discretion, and historical User Content may remain visible on the Website.
You are responsible for your User Content. By submitting User Content, you represent that you own it or have the right to submit it, and that it does not infringe anyone’s rights or violate any law.
License to us. You grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, display, and distribute your User Content in any media, and to use any name or username you submit with it.
Public by nature. User Content is publicly visible. Do not submit anything you want kept private — including your Social Security number, VA file or claim number, service number, date of birth, financial account information, medical information, or contact details. We are not responsible for information you choose to make public.
Prohibited User Content includes anything unlawful, defamatory, harassing, threatening, obscene, hateful, fraudulent, or infringing; spam or commercial solicitation; links intended to manipulate search rankings; and personal information about another person submitted without their consent.
No obligation to monitor. We have no obligation to monitor, review, or moderate User Content, and we do not endorse it. We may, at our sole discretion and without notice, refuse, edit, remove, or disable access to any User Content, or close comments entirely, for any reason or no reason. Removal of some User Content does not create an obligation to remove other User Content.
User Content is not our advice. Statements made in User Content are those of the person who submitted them and do not represent our views or constitute professional advice of any kind.
12. Copyright Complaints (DMCA)
We respect intellectual property rights. If you believe content on the Website infringes your copyright, send a written notice to our designated agent containing:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material claimed to be infringing and information reasonably sufficient to let us locate it (a URL is best);
- Your name, address, telephone number, and email address;
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Repeat infringers. We may terminate access for users who repeatedly infringe.
Misrepresentation. Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages.
13. Email Communications
If you subscribe to our email communications, you consent to receive newsletters, benefit updates, promotional messages, and similar communications from us. Every marketing email includes an unsubscribe link, and you may opt out at any time. Certain transactional or administrative messages are not subject to opt-out.
Our email messages may contain tracking technologies that tell us whether a message was opened and which links were clicked. See our Privacy Policy.
14. Termination and Availability
We may suspend, restrict, or terminate your access to the Website at any time, without notice, for any reason, including a violation of these Terms.
We may modify, suspend, or discontinue the Website or any part of it at any time without notice. We are not liable to you or anyone else for doing so.
The Website is provided on an as-available basis. We do not guarantee uninterrupted or error-free availability.
Sections 5 through 12 and Sections 15 through 21 survive termination.
15. Disclaimer of Warranties
THE WEBSITE AND ALL CONTENT, TOOLS, CALCULATORS, AND SERVICES ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT: THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; DEFECTS WILL BE CORRECTED; THE WEBSITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR ANY CONTENT, INCLUDING ANY BENEFIT RATE, ELIGIBILITY RULE, PAY FIGURE, INTEREST RATE, OR CALCULATOR RESULT, IS ACCURATE, COMPLETE, CURRENT, RELIABLE, OR APPLICABLE TO YOUR CIRCUMSTANCES.
YOU USE THE WEBSITE AT YOUR OWN RISK.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BENEFITS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM: RELIANCE ON CONTENT OBTAINED FROM THE WEBSITE; A BENEFIT, CLAIM, LOAN, OR APPLICATION THAT IS DENIED, DELAYED, OR GRANTED ON TERMS OTHER THAN THOSE YOU EXPECTED; THE ACTS OR OMISSIONS OF ANY THIRD-PARTY ADVERTISER, LENDER, INSURER, OR PARTNER; OR UNAUTHORIZED ACCESS TO YOUR INFORMATION.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE WEBSITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of these limitations may not apply to you.
17. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.
Informal resolution first. Before starting an arbitration, you agree to try to resolve the dispute informally by sending a written notice describing the dispute and the relief you seek to info@elevationmarketinginc.com or to the address in Section 21. We will do the same. If the dispute is not resolved within sixty (60) days, either party may begin arbitration.
Agreement to arbitrate. Except as set out below, any dispute, claim, or controversy arising out of or relating to the Website, these Terms, or our relationship — whether based on contract, tort, statute, fraud, misrepresentation, or any other legal theory — will be resolved by binding individual arbitration, not in court.
Arbitration procedure. The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, available at adr.org. The arbitration will be conducted by a single arbitrator. Unless the parties agree otherwise, the arbitration will take place in Wake County, North Carolina, or, at your election, in the county where you reside, or by telephone or video conference. The arbitrator’s decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.
CLASS ACTION WAIVER. YOU AND WE EACH AGREE THAT ANY PROCEEDING WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING. YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY.
Exceptions. Either party may bring an individual action in small claims court. Either party may seek injunctive or other equitable relief in court to protect intellectual property rights. Nothing in this section prevents you from reporting a matter to a government agency.
YOUR RIGHT TO OPT OUT. You may opt out of this arbitration agreement by sending written notice to info@elevationmarketinginc.com or to the address in Section 21 within thirty (30) days of the date you first accept these Terms. Your notice must include your name, address, and a clear statement that you want to opt out of arbitration. Opting out will not affect any other part of these Terms and will not affect your use of the Website in any way.
Severability. If the class action waiver above is found unenforceable as to a particular claim or request for relief, that claim or request will be severed and heard in court, and the rest of this section will remain in effect.
Survival. This section survives termination of these Terms.
18. Indemnification
You agree to indemnify, defend, and hold harmless Elevation Marketing Inc., USMilitary.org, and our officers, directors, employees, agents, affiliates, licensors, and suppliers from any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: your use of the Website; your User Content; your violation of these Terms; or your violation of any law or the rights of any third party.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense. You agree to cooperate with our defense.
19. Governing Law and Venue
These Terms and any dispute arising out of them are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles.
Subject to Section 17 (Binding Arbitration), you and we agree that any action not subject to arbitration will be brought exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to the personal jurisdiction of those courts.
The Website is operated from the United States. We make no representation that it is appropriate or available in other locations. If you access it from outside the United States, you do so on your own initiative and are responsible for compliance with local law.
20. General Provisions
Entire agreement. These Terms, together with our Privacy Policy and California Privacy Policy, are the entire agreement between you and us regarding the Website and supersede all prior agreements and understandings.
Severability. If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will stay in full force.
No waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them without restriction, including in connection with a merger, acquisition, or sale of assets.
No third-party beneficiaries. These Terms do not create rights in any third party, except that our officers, directors, employees, agents, affiliates, licensors, and suppliers are intended beneficiaries of Sections 15, 16, and 18.
Headings. Section headings are for convenience only and do not affect interpretation.
Force majeure. We are not liable for any failure or delay caused by circumstances beyond our reasonable control.
